Special Note

Note: to Bidder

Bidders should know that the Seller and the original artist were in a dispute. The artist in an irrevocable agreement conveyed all rights to the Verdult brand and name to the Corporation. The artist filed suit against the Seller. The Seller filed a 100 counter claims suit against the artist. The artist did not prevail in his suit, and the matter was voluntarily dismissed from Court with the contract still in full force and effect. However, the artist and his son through written statement and video continue to make false defamatory remarks against Seller and the Corporation. The Seller placed liens on several pieces of artwork not pertaining to this listing, and through its attorney lodged a multi-million defamation suit against artist.

In the suit 20 specifics false statements and acts of defamation either verbal or in writing are listed ranging from alleged crimes committed by Seller, FBI involvement to claims that the Seller statements about his military record is false. Because “Cybel Libel” defamation on the Internet is so intrusive, the Seller has requested through the Court against those that defame for an injunction, damages, special damages, and punitive damages.

These actions have no bearing on the ownership or the authenticity of the item listed. The Seller warrants that all items listed are owned by the Seller and they are indeed authentic. The Buyer is encouraged to conduct their due diligence prior to bidding, and if there are any questions about the listing, ownership, authenticity or the suit for defamation, please ask prior to bidding.

Though the Seller has made every attempt to stay away from controversy, the Seller must protect its brand, assets and shareholders. In the long haul most often controversy has helped the value of artwork. In this case, the results will probably be the same. The art offered is in fact art created by a listed American artist, and its value has been substantiated independently by the National Institute of Appraisers and three independent audits by SEC sanctioned certified public accounting firms.
