Personal property purchased from the U.S. Government may or may not be authorized for export/import from/into the country where the personal property is located. If export/import is allowed, the purchaser is solely responsible for obtaining required clearances or approvals. The purchaser also is required to pass on this export control guidance if the property is resold or otherwise disposed.
The purchaser must be a United States citizen or permanent resident alien and/or if purchasing for a company or corporation, the company or corporation is a United States owned company or corporation. Purchasers must complete a Citizenship Self-Certification form and an Export Control and Proliferation Sensitive Property Acknowledgement form. Copies of this form can and should be viewed by clicking on the due diligence tab above. By placing a bid on this auction, all bidders are certifying that they have read and agree to sign the Citizenship Self-Certification form, and an Export Control and Proliferation Sensitive Property Acknowledgement form. Bidders that win an auction and do not sign these forms will forfeit their winning bid amount. The winning bid shall be considered an agreement to buy and is final. This asset is listed and sold on an "AS IS, WHERE IS AND WITH ALL FAULTS" condition as of the date of sale. Bidders are required to conduct any research or due diligence of an asset prior to making a bid. Buyers are responsible for loading, securing and transporting purchased property, to include all costs and risks associated with removal.
Certified or cashier's check or money order must be made payable to Brookhaven National Laboratory, and sent to Cynthia Vongerichten, Building 400-D, PO BOX 5000, Upton, NY, 11973. Payment must be received within 15 days of the close of the auction.
Export Restriction Notice
The following Export Restriction Notice shall be included in all transfers, sales or other offerings of unclassified information, materials, technology, equipment or software pursuant to a DOE contract:
The use, disposition, export, and re-export of this property are subject to export control laws, regulations and directives that include but are not limited to: the Atomic Energy Act of 1954, as amended; the Arms Export Control Act (22 U.S.C. § 2751 et seq.); the Export Administration Act of 1979 as continued under the International Emergency Economic Powers Act (Title II of Pub. L. 95-223, 91 Stat. 1626, October 28, 1977); Trading with the Enemy Act (50 U.S.C. App. 5(b) as amended by the Foreign Assistance Act of 1961); Assistance to Foreign Atomic Energy Activities (10 CFR part 810); Export and Import of Nuclear Equipment and Material (10 CFR part 110); International Traffic in Arms Regulations (22 CFR parts 120 through 130); Export Administration Regulations (15 CFR parts730 through 734); Foreign Assets Control Regulations (31 CFR parts 500 through 598); DOE Order 142.3A, Unclassified Foreign Visits and Assignments Program, October 14, 2010; DOE Order 551.1D, Official Foreign Travel, June 24, 2008; and DOE Order 580.1A, Department of Energy Personal Property Management Program, March 30, 2012; and the Espionage Act (37 U.S.C. 791 et seq.) which among other things, prohibit:
(1) The making of false statements and concealment of any material information regarding the use or disposition, export or re-export of the property; and
(2) Any use or disposition, export or re-export of the property which is not authorized in accordance with the provisions of this agreement.
