The Philadelphia Land Bank may acquire your property through “priority bid,” a non-competitive bid that prevents others from bidding.  If the Land Bank exercises its priority bid to purchase the property, no sale proceeds will be distributed to you or any “interested party.”

Rights of Interested Parties and Record Owner(s)

  1. Right of an “Interested Party” to Require Competitive bidding

    If you are an “interested party,” such as the property owner, mortgage holder, or lienholder, you may make a timely request that the property be sold through open, competitive bidding instead of by priority bid.

    • Under 68 Pa. C.S. § 2117(d)(4) and Philadelphia Code § 16-705, the Land Bank may acquire this property at a Sheriff’s auction for delinquent taxes (“tax sale”) through a priority bid in the amount of all outstanding City, School District, and PGW claims and liens. 
    • However, under § 16-705(3)(d), you may require open bidding by submitting a written request to the Land Bank at least ten (10) days before the scheduled tax sale. This request must include:(a) your full name; (b) contact information; (c) the property address; and (d) a description and documentation of your interest in the property (for example, owner or lienholder).
      • ·         If your request is timely and you are verified as an interested party, the Land Bank must allow competitive bidding. Competitive bidding could result in a higher sale price, which might be enough to allow funds to be distributed to you after payment of all municipal claims and other superior claims. Please note that requesting open bidding may delay the sale.
    • Right of a “Record Owner” to Reacquire the Property

    If the Land Bank acquires the property via a priority bid and you are the prior owner (owner of record), you may have the right to reacquire the property under Philadelphia Code § 16-705(3)(e) by taking the following steps:

    (a) Within sixty (60) days of the tax sale date, send written notice to the Land Bank by certified mail, return receipt requested, stating your intent to reacquire the property; and

    (b) Within sixty (60) days of delivering your notice of intent, pay the Land Bank the full amount of its priority bid.

    Bidding Requirements

    To bid on this auction, all bidders are required to become qualified by placing a deposit. The deposit of the winning bidder is automatically transferred to the seller at the end of the auction. If the winning bidder fails to perform on any auction, the entire BidDeposit will be forfeited to the seller. Non-winning bidder deposit refunds are mailed within ten (10) business days after the close of the auction. This deposit cannot be applied to other auctions.     Settlement Requirements

    Purchaser shall pay the balance of 10% of the total purchase price of all auctions won by 5:00 PM ET on the first (1st) business day following the Auction. Purchaser shall have 15 calendar days from the auction date to pay the remaining balance. Payments shall be made to Bid4Assets. No exceptions will be made. If the payment policy is not adhered to the winning bidder will forfeit their deposit to the Philadelphia County Sheriff’s Office and may be banned from future sales.
